Terms of Use

These Terms of Use ("Terms") govern access to and use of the Deliberate Health website and the Compass research application (together, the "Service"), provided by Deliberate Solutions, Inc. ("Deliberate," "we," "us," or "our"). By using the Service, you agree to these Terms. If you participate in a research study, the applicable protocol, informed-consent materials, and site requirements also govern your participation and study-data use.
1. Who May Use The Service
The Service is intended for authorized research study staff and enrolled study participants. Participant accounts are provisioned by authorized study staff; there is no public self-registration. You must provide accurate account information, protect your credentials, and promptly report suspected unauthorized access.
2. Intended Use And Limitations
Compass supports research workflows, guided check-ins, consented data collection, and authorized study review. It is not a medical device, emergency service, or substitute for professional medical advice, diagnosis, treatment, or clinician judgment. Do not use the Service for emergency communication. Call 911 or the appropriate local emergency service when immediate help is needed.
3. Google Health And Fitbit Connections
When enabled for an applicable study, Compass may ask a participant to authorize read-only access to Google Health information made available by Fitbit or another connected source. Access occurs only after the participant completes Google OAuth consent. Participants may decline the connection or later disconnect it. Google, Fitbit, device, and account terms may also apply, and Deliberate does not control the availability or accuracy of third-party services or devices.
4. Acceptable Use
You may not interfere with the Service, attempt unauthorized access, introduce malicious code, misuse another person's account or data, bypass study controls, or use the Service in violation of law or the applicable study requirements. We may restrict access when reasonably necessary to protect participants, study data, or the Service.
5. Privacy And Research Data
Our Privacy Policy explains how the Service handles information, including Google Health information. Study-specific collection, retention, sharing, withdrawal, and deletion rules are also described in the applicable informed-consent materials. If there is a conflict concerning study participation or research-data use, the approved study materials and applicable law control.
6. Service Availability And Changes
We work to keep the Service available and secure, but do not promise uninterrupted or error-free operation. We may update, suspend, or discontinue features when needed for security, compliance, maintenance, or study requirements. Material changes to these Terms will be posted here with an updated date.
7. Intellectual Property
Deliberate and its licensors retain all rights in the Service, software, branding, and related materials, except for rights expressly granted in these Terms or applicable study agreements. These Terms do not transfer ownership of participant or study data.
